Reynolds backed down when he tried to take possession as he was confronted by Heron and 60 other miners at the ‘battle of Pinnacle Hill.’ The case is to be heard in the Court of Petty Sessions on Tuesday.
ST, 20th March 1889 - Thomas heron was charged with: “on the 31st of January 1889 he unlawfully entered with force and arms the Pinnacle (G.L. no. 92) which up to that time had been in the quiet possession of Richard Peck and still forcibly detains the mine.” This was a sworn statement by Richard Peck, of Rookwood near Sydney, read to the Court. After much legal debate over technicalities and the question of whether it was a matter to be dealt with by the Warden’s Court, the information was dismissed.
The other case against Thomas Heron, John Minnikin, Matthew Herle, James Adams, Isaac Samuel M’Mahon, Henry Smith, Thomas Kells, Henry Ison, William Markham and Frederick Wilson was then heard. That they had “unlawfully by a threat of violence obstruct one William Henry Reynolds from working at his lawful occupation as a mining manager in the mine known as the Pinnacle.” “On the 22nd May, 1883 a lease was issued to Stephen Kelly of 3 acres, 2 roods, and 11 perches of Crown Land near Nowra, this lease being transferred to Messrs. Cope and King on the 17th August, 1885, who continued to hold it up to the present time, and in whom it was legally vested. Now this Stephen Kelly who transferred to Cope and King had a relative, one William Kelly, who worked on the lease for some time and then went to Sydney. But before going there he got his brother-in-law Thomas Heron to manage the mine. Heron carried on for a certain time when owing to want of funds he had to cease working in the month of May last. Subsequently a Mr. Dennis came down and examined the mine taking possession on behalf of Messrs. Cope and King, and up to the present it had remained in the possession of the gentlemen represented by Mr. M’Culloch. In January last arrangements were made whereby the mine was to be worked again, and he would show from defendant’s own letters the position in which he then stood towards the owners of the mine. In one of them Heron said ‘All I want is to see all the debts in my name cleared off so that I can get out of it honorably.’ He would show that Mr. M’Culloch authorised Peck to take charge of the mine, and that when later Reynolds was sent up to work in the mine, Heron and the other defendants, with a whole gang of sympathisers, so threatened and obstructed him that he was unable to gain access to the mine.” After much debate it was again decided that it was a matter for the Warden’s Court and the information was dismissed.
