Illawarra Mercury, Monday 21st October 1859 -

Meeting held on Thursday 27th October 1859, at the Police Office, Nowra,

All Aldermen present.

Moss moved 4 resolutions, and 1 amendment
Bice moved 1 resolution
McGuire moved 1 resolution

It was decided that Council was to meet every Saturday at 3 p,m, Tenders were to be called for the office of Town Clerk and the Mayor was to obtain copies of bye-laws and standing orders from Sydney, Shellharbour and Kiama Councils. He was also to obtain a map of the Municipality, from the Government, designs for a Corporate Seal, and any books necessary for Council. The road from Nowra to Greenwell Point, via Brundee, through Mr. Mackay’s land was to be opened and the Mayor was to request the Government to instruct Surveyor Rowland to survey and report on this road - postponed until next council meeting. Next meeting was to be held Saturday 12th November at a place to be appointed by the Mayor.

Illawarra Mercury, Thursday 24th November 1859 -

Meeting held on Saturday 12th November, in the Council Chamber.

Present - McGuire, Bice, Monroe, and Mckenzie. The Mayor was absent so Monroe was voted to the Chair.

Town Clerk Tenders were read:

  • Mr. William Thistleton, Terara, L50
  • Mr. Charles Innes, Cabbage-tree Creek, L40
  • Mr. Thomas Hazlewood, Greenhills, L30
  • Mr. Thomas Boyce, Nowra, L25; all per annum.

Innes and Boyce were selected for further consideration. McGuire moved that the tender of Boyce be accepted and Mckenzie and agreed. Bice was in favour of Innes; Monroe decided for Boyce whose tender was duly accepted.

All notices of motion before the Council were postponed to the next meeting.

McKenzie withdrew his Notice of Motion and substituted “That the Council should proceed to have the Public Ferry proclaimed, and to have proper rules, with a scale of charges, established forthwith.”

Adjourned until next Saturday, 20th November.

Illawarra Mercury, 28th November 1859 -

Meeting held on Wednesday 23rd November 1859 at 11 a.m.

Present - Mayor, Bice, MacKenzie, Munro and M’Guire.

The Minutes were read by Boyce, Town Clerk, and confirmed.

A letter to be sent to M’Arthur & Co. regarding the supply of stationery to Council and a cleaner to be engaged for Council chambers. Council then went into committee to consider bye-laws. The committee was ordered to report at next meeting. Meeting adjourned until Saturday 26th, the adoption of Bye-laws to take precedence over other business.

Meeting held Saturday 26th November 1859.

Present - Mayor, Monroe, Bice, McGuire, Moss and Mackenzie.

The bye-laws were approved. The Nowra to Greenwell Point road is to be surveyed. tenders to be called for one assessor for each Ward. Request for all reserves to be placed under the control of the Council. A committee was formed, and entered, to make laws and regulations for Bomaderry Ferry which was to be proclaimed without delay, and a copy of the ferry bye-laws to be distributed to each Councillor without delay. Council then resumed. Improvement committees to be established for each Ward. The road from Gerringong to Nowra, main south road, to be surveyed as soon as possible. All Government Reserves within the Municipality to be placed under Council control. That Government buildings be erected in Nowra township and the Government should pay the rent of a house, in Nowra, being used for the Court-house. Application to be made to the Commercial Bank for a L400 cash credit, upon approval of the Governor.

Meeting adjourned to December 3rd.

Illawarra Mercury, Thursday 8th December 1859 -

Meeting held Saturday 3rd December 1859.

Present - Mayor, Mackenzie, Bice, Monro, Moss and McGuire.

A letter was received from Randwick Council requesting support for the insertion, in the new Land Bill, of a clause placing all public reserves, within Municipalities, under the control of Councils.

Mackenzie moved 1 motion.

Standing orders suspended to consider an important motion. All sums of monet held by the Shoalhaven Bench for roads to be placed under the control of the Municipality. Council then went into to Committee to consider Bomaderry Ferry bye-laws. The bye-laws were then approved.

Illawarra Mercury, Thursday 15th December 1859 -

Meeting held 10th December 1859 at Council Chambers.

Present - Mayor, Mackenzie, Moss, Munroe and Bice.

Mackenzie moved 1 resolution
Moss moved 4 resolutions and amended 1 resolution, placed 3 on notice and withdrew 4 resolutions
Monroe moved 3 resolutions.

The Council Seal designed by Fletcher was adopted (Mackenzie). Thanks to Mr. Fletcher (Moss). Thanks to the other unsuccessful designers (Monroe). Bomaderry Ferry bye-laws confirmed and accepted (Monroe). The ferry was to be let by Public Auction to the highest bidder (Moss), but this amendment was lost. Support to be sought from Kiama, Shellharbour, Central Illawarra and Wollongong Councils to repeal Clause 80 of the Mun. Act and replace with a provision of appeal to the nearest Quarter Sessions (Moss). That the Colonial Secretary be contacted with a view to having all Police cases occurring in the Municipality to be heard at Nowra (Moss). That the Nowra improvement Committee meet to

  1. Consider Nowra’s Water Supply
  2. Clear the road through Nowra, Kinghorne Street, and thence on to Yellow Water Hole
  3. Review all roads in Nowra (Moss)

Moss’ three resolutions on notice -

  1. Rate payers lists for each ward to be prepared
  2. A maximum rate to be fixed for the assessors
  3. Consider employing a surveyor to mark the Municipal boundaries and the lines of purchased or grants thereon.

Illawarra Mercury, Thursday 22nd December 1859 -

Meeting held 17th December 1859 in Council Chambers.

Present - Mayor, M’Guire, Moss, Bice and M’Kenzie.

Bice moved 3 resolutions
Moss moved 1 resolution, postponed 2 resolutions, placed 3 resolutions on notice and asked the Mayor 2 questions.

Letter received from M’Arthur regarding the construction of a new wharf opposite the Iron Store at Greenhills. The Mayor in answer to a questions by Moss it was stated that

  1. Council Chambers were rented at a cost of 2s. per week, as per resolution of 27th October.
  2. The road through Terara was outside of the Municipality so he declined to notice it.

A committee was formed to consider the tenders for the two positions of assessors (Bice). The following tenders were received -

  • Charles Innes, not in the required form so it could not be received
  • Peter McLaren and John Gibson, L70 @ 18s per day, there being not less than 40 days work
  • Robert Lindsay and Henry Hodgkinson, L80 @ 18s per day, there being not less than 6 weeks work

The tender of McLaren and Gibson was accepted (Bice). Rate payer lists to be prepared (Moss).

Adjourned to 31st December 1859 (Bice).

Illawarra Mercury, 6th January 1860 -

Meeting held at 4 p.m. on Saturday 31st December 1859 in Council Chambers.

Present - Mayor, McGuire, Moss McKenzie and Bice.

Letter sent to the Colonial Secretary with the design of the Council Seal. Letters received from the Colonial Secretary; Kiama Council with a copy of their standing orders; Secretary for Works saying that the survey of the Nowra to Greenwell Point road, and others, would begin shortly.

Moss moved 2 resolutions, withdrew 2 notices of resolutions, placed 3 on notice and asked 2 questions

McGuire placed 3 resolutions on notice.

Meeting dates set for the Nowra and Good Dog Improvement Committees. Standing orders were suspended to consider M’Arthur’s letter of 27th December (Moss). That M’Arthur be given permission to build a wharf adjacent to his Iron Store, provided it is a Public Wharf, subject to Council rules and regulations (Moss). Moss, Bice and McGuire were in favour whilst the Mayor and McKenzie were against. Motion carried. Supplementary Bye-laws for the guidance of the Council to be tabled at the next meeting.

Illawarra Mercury, Friday 13th January 1860 -

Meeting held at 4 p.m. Saturday 7th January 1860 in the Council Chamber.

Present - Mayor, Bice, Moss, Maguire, Munro and McKenzie.

The reports of the Nowra and the Good Dog Improvement Committees were received. Letters were sent to the Secretary for Lands regarding repairs to the Braidwood and River Bank roads; Mr. M’Arthur giving permission for the construction of his wharf with the conditions attached; and James Graham regarding the changes to the line of road leading to Nowra which passes through his land. A letter was received from Shellharbour Council stating that they were not willing to support changes to the Mun. Act.

The sale of the Bomaderry Ferry is to be discussed after its proclamation (McGuire & Bice). That the sanction of the Governor be sought to obtain credit of L400 (Moss). That Council guarantee the rent of the Nowra Court-house (Moss). The Supplementary Bye-laws were presented by the Mayor and adopted (Bice).

Illawarra Mercury, Friday 20th January 1860 -

Quarterly Meeting held on Tuesday 12th Janaury 1860 at Council Chamber.

The meeting was originally called to begin at noon, but only the Mayor, Moss and McKenzie were present which did not constitute a quorom. It was then adjourned until 4 p.m.

Present - The Mayor and all Councillors.

Letters sent to the Colonial Secretary regarding raising L400 credit and another enclosing a copy of the bye-laws; Secretary of Lands regarding the correct name of Bomaderry Ferry. Letters were received from Secretary for Lands informing Council that the Ferry bye-laws had been received and submitted to the Law Officers of the Crown, and another enclosing a copy of a map of the Municipality; James Graham permitting changes to the line of the road on his land.

  2. The right of voting in both Wards when the rateable property is so situated
  3. The use of the ballot box, from James Aldcorn (Munro)

Meeting held on 21st January 1860 at Council Chamber at 5 p.m.

Present - Mayor, Bice, Moss, M’Guire, M’Kenzie and Munro.

Letters received from Central Illawarra Coiuncil declining to support the change in the Mun. Act; the Government Printing Office’s account for rngraving the Common Seal; Colonial Secretary pointing out the conditions governing a loan for permanent works; the Mayor of Sydney regarding certain queries Council had made regarding voting rights.

The Good Dog Improvement Committe Report was read and accepted (M’Kenzie). The Nowra Improvement Committee Report was adopted (Mayor). A motion by Moss that L25 be spent on a road, from from the main Nowra Hill road, to the farms on Currambene Creek was referred, by amendment, to the Nowra Improvement Committee (Munro). Council then went into committee to set the rates, rules and regulations for the licensing of slaughter houses (Moss). Four laws were passed, and further consideration is to be given to the matter at the next meeting (Moss). Full Council considers steps to be taken to suppress nuisances (Munro) and decided that failing to suppress or remove a nuisance, after being issued a notice by the Town Clerk, would result in a fine of between 10s and L5 (Munro).

Illawarra Mercury, Friday 10th February 1860 -

Held on Thursday 2nd February 1860 at 4 p.m. in Council Chamber.

Present - All of Council.

Letters from the Colonial Secretary regarding the Common Seal, and another regarding making certain changes in the bye-laws.

Consideration of the bye-laws regarding Slaughter Houses postponed (Moss). Mayor requested to make arrangements with William Gollan for the continued use of his property as the Nowra Court-house (Bice). Town Clerk directed to write to the Colonial Secreatry regarding the bye-laws of Kiama and Waverley as bearing on Shoalhaven’s bye-laws; to the Bench of Magistrates and Mr. Alley requesting recent correspondence regarding Nowra Court-house; to John Garrett requesting his support for change in the Lands Bill, vesting control of Public Reserves in their respective Councils as per recommendation of Randwick Council.

The Council is to meet as a Court of Revision on Saturday 4th February at 4 p.m. The Town Clerk was requested to copy the Assessment Roll for ratepayer’s inspection. The Nowra Improvement Committee is to meet on Friday 10th February at 4 p.m.

Illawarra Mercury, 21st February 1860 -

This was the first Council meeting after the 2nd election and was held on Thursday 16th February at 4 p.m. in Council Chamber.

Present - Aldermen Moss, M’Guire, Graham, Bice, McGrath and Munro.

Letters sent to the Colonial Secretary regarding bye-laws; Secretary for Lands regarding the Gerringong to Nowra road; the Bench of Magistrates; George Underwood Alley; and Randwick Council.

M’Guire moved 2 resolutions
Moss moved 1 resolution and gave 3 notices of resolution regarding Mayoral nominations
Bice moved 2 resolutions
M’Grath moved 1 resolution.

Moss took the chair (M’Guire). Mayoral Election : Munro, nominated by Bice; Moss nominated by M’Guire; Graham, nominated by M;Grath. Graham was elected as Mayor.

Standing Orders were suspended to enable the Town Clerk to countermand a motion calling for tenders for public works (Moss).

Illawarra Mercury, Friday 2nd March 1860 -

Meeting held Saturday 25th February 1860 at 4 p.m. in Council Chamber.

Present - Mayor, Moss, Munro, M’Guire and M’Grath.

Moss, as Returning Officer, handed in an Election Results Certificate, witnessed by Thomas Boyce as Poll Clerk. Papers relating to the election were sealed and given to the Town Clerk, as a record of Council.

Letter from the Secretary of Lands informing Council that Bomaderry Ferry was to be proclaimed a public ferry and handed over to Council. Letters were sent to the Registrar-General containing an abstract of audited accounts of Council up to 31st December 1859; Richard kemp requesting the return of the Common Seal.

Standing orders were suspended to consider certain motions (Moss). That Kemp be requested to hand over the Seal to the Mayor (Moss). Mayor to request John Garrett to obtain money granted for the Braidwood road, so that Council can superintend the repair of 12 miles of the same (Moss). McGrath and Graham to be appointed to the Good Dog and Nowra Improvement Committees, respectively, and a lot to be held for the fourth member of the Good Dog Committee (Moss). Graham was then appointed. Council to go into Committee to consider the damage to the River Bank road (Moss). This matter was referred to the Nowra Improvement Committee. Discussion on the regulations relating to Slaughter Houses postponed to the next meeting. The Mayor is to contact the Surveyor-General to expedite the survey of the Brown’s Mountain road (Moss).The Mayor is also to contact the Surveyor-General to expedite the survey of the Nowra to Greenwell Point road.

Illawarra Mercury, 9th March 1860 -

Special meeting held on Friday 2nd March at 1 p.m. in Council Chamber.

Present - Mayor, M’Guire, Moss, M’Grath and Bice.

To Consider a letter from the Treasurer of the Sydney Relief Fund Committee.

Moss moved - “That in consequence of the door of the chamber being locked, and the table and chairs removed, that the Council now forthwith adjourn this and other meetings to the Court House at Nowra.” The motion was carried the only dissenter being Bice.

Council then reassembled in the Court House.

Bice handed in his resignation PROVIDED Council had the power to remit the legal penalty for doing so. The Town Clerk then read a letter from Bice and after deliberation Council declined to accept his resignation and the letter was withdrawn.

The letter from Sydney was then read requesting information on the amount of damage caused by the Shoalhaven flood, and requesting that the Council co-operate with the local Bench of Magistrates. A reply, from the Mayor, was then read in which he promised to convene a special meeting and thanking them. The Town Clerk was then directed to write to the Local Relief Committee, stating Council’s willingness to co-operate with them. A letter was then read, from James Warden to henry Moss, respecting the dispersal of funds collected at Ulladulla for relief of the sufferers. A reply was to be sent to Warden requesting that the funds be placed in the hands of the Mayor, in his role as Chairman of the local relief committee, with whom Council will full co-operate. Warden’s letter to be placed on record (Moss).

Moss then presented certain printed Parliamentary Papers and correspondence relating to the formation of the Municipality before Council, which were also to placed on record.

Present - Mayor, M’Guire, Moss, M’Grath and Munro.

Letters to Surveyor-General requesting the survey of certain roads; the Colonial Secretary enclosing the Certificate of Election; Mayor of Sydney; John Garrett; Local Relief Committee; Charles Kemp, Treasurer of the Sydney Relief Committee; James Warden. Letter from Town Clerk of Sydney Council regarding Slaughter Houses.

Standing orders were suspended and Council is to meet in the Court House in future (Moss). The Council the considered the letting of the Bomaderry Ferry (McGuire). Council then went into Committee to consider the issue of the Bomaderry Ferry (Moss). A letter was to be sent to the Government stating that Council was ready with punts, &c., and requesting the confirmation of bye-laws, Tenders for letting of ferry to be advertised. Council then resumed. Standing orders were suspended. The mayor is to apply for L250 to the Minister for Works for road works (Moss). Arrangements to be made to pay up the rent and deliver up old Council Chambers to Watts, the owner (M’Guire).

Illawarra Mercury, 16th March 1860 -

meeting held Saturday 10th March at 4 p.m., in Nowra Court House.

Present - Mayor, Moss, M’Guire, Munro and M’Grath.

Letters sent to the Secretary of Lands regarding the Ferry; and John Garret regarding money for public improvements. Letter from the Secreatry for Lands regarding the road money, held by the Bench of Magistrates, will communicate further.

Moss moved for a suspension of standing orders “for the purpose of passing a vote of censure on Aldermen M’Grath and Munro for endeavouring to obstruct the business of the Council, and in publicly acknowledging, at this meeting, that they had signed a petition against the Municipality.” Carried by four votes to two, unsurprisingly those of M’Grath and Munro. The Town of Nowra should have three Aldermen, in addition to the present number, and a copy of this resolution is to be sent to the Colonial Secretary. Carried four to two, M’Grath and Munro again voting against (Moss). Council went into Committe to consider bye-laws (Moss). Council then went into Committee again, to consider the rate of assessment (Moss). The rate is set at 6d in the pound (Moss).

Meeting held Saturday 17th March 1860 at 2 p.m., in Nowra Court House.

Present - Mayor, M’Guire, Moss, Munro and Bice.

Letters to the Colonial Secretary regarding the resolution passed asking for 3 additional Aldermen for the Town of Nowra; Sydney Relief Fund Committee. Letters from the Secretary for Lands regarding the Kiama to Nowra road; The Bench of Magistrates regarding road money.

Council went into Committee to consider the Ferry tenders :

Quarterly payments, not in advance, to be made and the tender of John Miller was accepted, subject to the Government proclamation (Moss). Council then resumed. Town Clerk to advertise for tenders to serve rate notices.

Illawarra Mercury, Tuesday 17th March 1860 -

Special meeting held Monday 23rd March 1860 at 4 p.m., in Nowra Court House.

Present - Mayor, Bice, Munro and M’Grath.

Meeting was called to discuss a letter from John Miller wishing to have his ferry contract cancelled “urging want of physical strength as the principal cause.” Miller’s contract was cancelled (Munro) and the tender of William Kennedy accepted (Bice). Security of L40 from Kennedy and sureties of L20 each from Alexander Mallock, of Nowra, and William Sayers, of Terara, for the performance of the contract.

Meeting held on Saturday 30th [sic] March 1860 at 4 p.m., in Nowra Court House.

Present - Mayor, Munro, Moss, Bice, M’Grath and M’Guire.

Letter sent to the Secretary for Lands regarding Bomaderry Ferry. Letters received from the Department of Lands regarding the name of the ferry, and another regarding the proposed road from the ferry to Nowra; from Colonial Secretary regarding the proposed division of Nowra Ward; the Surveyor-General promising attention to the survey of Brown’s Mountain road; and the Assessor regarding payment for valuations.

Tenders for the serving of Rates Notices :

“The Mayor, by clause 27 of the By-laws, put the question of the tender of John Smith.” Ayes: 2, Aldermen Bice and Munro; Noes: 4, Aldermen Moss, M’Guire, M’Grath and the Mayor. Not accepted. The tender of E.W. Booty was accepted 4 votes to three, Bice, Munro and McGrath against. Council then went into Committee to consider various bye-laws, which were read out and passed. Council then resumed. The Postmaster-General is to be asked to move the recently established post-office, on the river bank, to Nowra. This was carried with Munro and M’Grath against (Moss).

Meeting held, n.d., at Nowra Court House at 2 p.m.

Present - Mayor, Bice, McGrath, McGuire, Moss and Munro.

Letters received from the clerk of the Legislative Council conveying permission for Council to attend the Select Committee regarding Berry’s petition; Shellharbour Council requesting Council to send representatives to meet other delegates to consider amendments to the Municipality Act; from Kiama Council asking Council to request the Minister for Works for a ‘Great South Main Line of Road; from John Garrett regarding various matters raised in previous correspondence with him; from B. Owen, of Wollongong, stating that he has no land in Good Dog Ward. Letters sent to the Surveyor-General regarding the Good Dog to Bomaderry Ferry road, and survey of the proposed road from Nowra to the ferry.

A petition from 74 rate payers requesting Council not to sanction the proposed road, along Layton’s section line, from Bomaderry to Nowra was received (Moss). The assessment on Michael Hyam was reduced from L157 10s to L125. Tenders for works :

Smith’s tender for roads and Scheidell’s for bridges were accepted.

Standing orders were suspended to consider objections to the proposed Bomaderry to Nowra road (Moss). The Mayor is to request the Surveyor-General to survey, the previously nominated, old road from the Ferry to Nowra and proclaim it without delay. Bice moved that standing orders not be suspended and the resulting vote was locked. The Mayor cast in favour of the motion. The Finance Committee recommended L15 for repairs to North Street in Nowra. L10 to be paid to Booty for serving assessment notices.

Fresh tenders to be invited for clearing and stumping East and North Streets, Nowra, Sureties to sign a certificate, to be enclosed with the tender, in consequence John Smith not being able to supply with the sureties required for his contract. Finance Committee recommends payments to John M’Arthur & Co., for L5 11s 6d; and the Assessor L20 on account.

Letters to be written to the proper Department regarding the confirmation of the ferry bye-laws, and to insert a clause in the General Bye-laws regarding the process of levying and gaining warrants &c., in District Courts; to Shelharbour Council in reply to their letter; the Bench of Magistrates requesting that all Police cases be held at Nowra Court House.

A select committee be appointed to consider the petition of Berry, now before the Legislative Council (Moss). The attention of the Surveyor-General be brought to the immediate necessity of surveying a line of road from Nowra to Greenwell Point via Brundee (Moss). Moss moved 4 resolutions, gave notice of 6 others and withdrew 1. As Chairman of Council’s Select Committee, presented a report on the proceedings regarding Berry’s petition.

Tender of John Scheidell, for the clearing of North and East streets, with sureties, for L30 accepted. The tender of Christopher Murray, for L34 to fill the hole at the Iron Store was accepted.

Moss presented the Report regarding Berry’s petition which was received and adopted (Moss). Town Clerk to forward a copy to the Legislative Council’s Select Committee. No official letter is to be written except by resolution (Moss). This motion was passed by 3 ayes, including the Mayor, against 2 noes - Bice and McGrath. The Surveyor-General is to be asked whether a road through the Shoalhaven to Bong Bong has been proclaimed and if so could Council obtain a tracing of same (Moss). Moss withdrew his motion to transmit the petition regarding the Ferry road to the Surveyor-General, which was opposed by Bice but eventually agreed to.

The Town Clerk was instructed to prepare certain important legal documents. The Nowra to Nowra Creek road was referred to the Nowra Improvement Committee for consideration (Moss).

A note on the Mayor at the last meeting to be erased (Bice). The Mayor to sign warrants of distress against rate defaulters, as soon as the recent bye-law is officially confirmed, and employ a bailiff (Moss). A petition was received. That since Crown Land has been ‘discovered,’ that Berry claimed as his, which could be readily sold it should be ascertained if any other sections of Berry’s land is the same. Mayor to take the proper steps to carry out this object (Moss). The Town Clerk is to write to Surveyor Mann saying that Bice and M’Grath will accompany him when surveying the roads from Brown’s Mountain to the ferry, and Good Dog to the ferry. Bice will also offer him information on the road from Kiama to Bomaderry, via Broughton’s Creek.

The report of the Nowra Improvement Committee was read and received. Munro and Moss reported on the amendments proposed, to the Municipalities Act, which were discussed at the Kiama Meeting. Standing orders were then suspended to consider a circular from the Attorney-General (Munro). Sundry amendments, in reply, were proposed and adopted which were to be sent to the Attorney-General. Specifications to be prepared and tenders called for works on the Main Southern Road (Moss). Specifications adopted for two bridges on the Main Southern Road and Mr. C. Morrel’s tender, of L14, for the causeway accepted. A map of Nowra, outlining sections and the original purchasers to be requested from the Surveyor-General (Moss).

Tenders for two bridges on the Main Southern Road and Patrick Casey’s one for L37 accepted. As soon sas funds are placed to credit of Council, L30, if practicable, to be paid to the valuators Messrs. M’Laren and Gibson (Moss). Mr. Gollan to be paid his rent, of L20, for the Court House (Moss). That application be made to the Government for money to open the new road from Nowra to ‘the Yellow Water,’ on the Braidwood road, which was recently surveyed by Mann (Moss). That Joh Garrett be requested to move in Parliament that the ‘Report of the Shoalhaven Municipality on the Berry Petition’ be printed (Moss). The Post-Master General be communicated with regarding Mr. Murray’s offer to receive and deliver mail in Nowra, at L5 p.a., extra (Moss). That a distress warrant be issued against the goods and chattels of John Smith, a rates defaulter (M’Guire). A scale of costs was accepted in relation to the execution of Distress Warrants. tenders to be invited for repairs to the Southern Road.

Special Meeting held on Wednesday 17th October 1860 at Noon, in the Council Chamber.

Present - Mayor, Moss, M’Guire and Munro.

The Mayor stated the object of the meeting whereon Council resolved itself into a Committee and sat with closed doors. On rising the following resolutions were reported :

  1. “That as the Mayor has received a Writ at the instance of Alexander berry, Esq., in consequence of the steps taken by Council to recover the rates due by Messrs. Berry, it is hereby resolved and distinctly understood that the warrant issued by the Mayor against the Messrs. Berry is with the full concurrence of this Council.”
  2. “That the different Municipalities throughout the colony be communicated with by circular, requesting their co-operation and support in assisting this Council to meet the question raised by the action now pending, on the part of Alexander Berry, esq., against the Mayor for exercising his authority in enforcing the payment of rates.”

A select committee of the Council was appointed to carry out the above aims and to defend the legal rights of the Municipality by all such steps as may be deemed necessary against Mr. berry, or any other person whatever.

The Finance Committee met a 3 o’clock, and elected Alderman Moss as chairman. Several accounts were examined and others deferred.

Meeting held on Saturday 3rd November 1860 at noon, in Nowra Court House.

Present - Mayor, M’Guire and Moss.

Letters sent to the Department of Trade and Finance; the solicitors retained by Council to defend the Mayor against the action taken by Alexander Berry. Letters received from the Department of Lands regarding the roads money; and Messrs. Dunsmore and Stafford replying to a letter from Council.

The report of the Finance Committee was tabled. Standing orders were suspended. A committee consisting of the Mayor, Munro, Moss and M’Guire to revise bye-laws (Moss). A circular was submitted and 100 copies were authorised to be printed. The Mayor, under clause 40 of the bye-laws, authorised a L10 road repair contract which was duly certified by two Aldermen. John Rushton’s application for a Slaughtering License was postponed. The Surveyor-General is to have a surveyor mark the names of recent Crown land purchasers, within the Municipality, on a map.

Meeting held Wednesday 21st November 1860 at 2 p.m., in the Nowra Court House.

Letters sent to the Secretary for Lands regarding the expenditure of the Bench of Magistrates roads money, by Council, on the Southern Coast road, and another surveys in the district to be placed on maps of the Municipality. Letters received from Secretary for Lands regarding the authorisation of a road from Nowra Hill to the Braidwood road, and also one stating that L3 per mile, subject to Assembly approval, is to be placed at Council’s disposal for Municipal roads.

Report of the Finance Committee received and confirmed. The Town Clerk was instructed to write to :

  1. Hon. Secretary for Lands regarding the above mentioned grant.
  2. K. MacKenzie, Esq., [of the bench of Magistrates] regarding money for repairs to the South Coast road.

Council then went into Committee. The Bye-Law Committee Report was read and accepted after which Council resumed. Bye-laws to be forwarded to the Executive for confirmation (Moss). John Rushton’s Slaughtering License was refused being less than 200 feet from the road, which is contrary to the bye-laws.

The Finance Committe Report was tabled and read, then received and adopted (Moss). Patrick Casy’s contract money to be paid forthwith (Moss). Bice and Munro voted against this but it was carried.

In a reply to a question from Bice, the Mayor replied that no official communication regarding the Shoalhaven to Berrima Road [Moss’ Road] had been received. He also replied, to the Town Clerk, that no alteration had been made in Berry’s rate assessment. A communication is to be sent to the Postmaster-General to request that the Bomaderry ferryman to convey mail to a temporary post office at, say, Bolong for the convenience of the inhabitants north of the river, until the Bomaderry to Broughton’s Creek road is proclaimed (Moss). An amendment by Bice asked that the Postmaster-General should authorise that a post boy should also be sent to the national School at Good Dog for the convenience of the inhabitants. The amendment was carried with Moss and M’Guire voting against it. The Treasurer was directed to send a list of rate defaulter to the Town Clerk, by Wednesday the 5th, and the Mayor was then to use his discretion to issue Distress Warrants. After receiving several requests, adjustments were made to some rate assessments.

Meeting held on Saturday 22nd December 1860.

Letter sent to Postmaster-General regarding the provision of a mail bag at Good Dog. Letters received from Dunsmore and Stafford, solicitors; Department of Lands regarding credit for roads money; the Treasurer stating that the last half yearly endowment to Council will be paid; Central Illawarra, Shellharbour and Paddington Councils regarding the circular.

A brief is to be furnished by Mr. Windeyer, Barrister, on ‘the plea now pending (Moss). ‘That the lands within the Municipality be divided into six divisions, viz : -

    1st Division - First Class Agricultural Land - Improved
    2nd Division - Second Class Agricultural - Unimproved
    3rd Division - First Class Pastoral Land

In a response to a ratepayers petition, Miller’s Lane is to be repaired under the supervision of M’Grath. Mr. C. Flynn to be advised that after considering his letter, the Treasurer would be authorised to make payment on account. The Town Clerk was directed to have the auditors attend the next meeting and to give public notice that defaulting ratepayers are to pay in full prior to 31st December.
